National Tailings Policy: new law to make profitable environmental liabilities

The proposal called National Tailings Policy, seeks to take charge of the environmental liabilities left by mining operations that ended their operation, prior to the current environmental legislation that holds the companies of these sites responsible.

The risks that these mining liabilities entail are mainly due to the presence of heavy metals, or the eventual contamination of groundwater and atmospheric problems due to the carry-over of particulate material.

To face this situation, the Government of Chile has prepared a series of new measures, depending on the condition of the tailings deposit. In this way, if the tailings are active, a modification will be made to Decree 248, which will oblige the mining companies to report the situation of the deposit online and in real time.
